General Terms and Conditions
1. Applicability
These general terms and conditions apply to all services provided by Victory Support (hereinafter "We" or "Us") to the customer (hereinafter "Customer"). By accepting our services, the Customer agrees to these terms.
2. Services
We provide water charter and offshore services using the vessel "Victory". The scope and details of the services are agreed upon in a separate quote or contract.
3. Liability
We aim to maintain the highest safety standards but are not liable for any damage, loss, or injury of any kind arising during or as a result of our services, unless it is due to gross negligence or intentional misconduct on our part. The Customer is responsible for adhering to all safety regulations and is required to have the necessary insurance in place.
4. Force Majeure
We are not liable for any delays, damage, or other losses resulting from force majeure, such as weather conditions, natural disasters, strikes, or other unforeseen circumstances beyond our control.
5. Payment and Rates
All rates are agreed upon based on a quote. Payment is due within the agreed period. In case of late payment, Victory Support reserves the right to suspend services and/or charge interest.
6. Customer's Responsibility
The Customer is responsible for providing accurate and complete information regarding the project and for complying with all applicable laws and regulations. The Customer is also responsible for securing the necessary permits and insurance in a timely manner.
7. Changes and Cancellations
We reserve the right to modify the services or terms, provided the Customer is notified in advance. Cancellations must be made at least 48 hours before the scheduled service, otherwise, cancellation fees may apply.
8. Intellectual Property
All rights to materials, data, and documentation provided by Victory Support remain the property of Victory Support. The Customer may not use or distribute these materials without permission.
9. Governing Law
These terms are governed by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.
10. Final Provisions
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain fully in effect.
